Currently Orochimaru's sealed within that thingy whatever it was and since Itachi died the thing should go with him but then if sasuke posseses his susanoo as well as itachi's then sasuke could release Orochimarus decomposed remains....so I think its safe to say that Orochimaru's dead

When Ooruchimaru died some of his remains were sealed within Sasuke and others in Kabuto, in a manner of speaking, some part of him is alive.
